Terms & Conditions
Article 1 — Purpose
These Terms and Conditions govern the contractual relationship between Lou & Gaston and any customer making a purchase on lou-gaston.com. Placing an order implies unreserved acceptance of these terms.
Article 2 — Products
The products offered for sale are those described on lou-gaston.com. Each product includes a detailed description and photographs. Photographs are not contractually binding. Lou & Gaston strives to present product colors and features as accurately as possible.
Personalized items (name embroidery, initials, etc.) are made to order based on the information provided by the customer at the time of ordering.
Article 3 — Prices
Prices are shown in euros, inclusive of all taxes. Lou & Gaston reserves the right to change prices at any time. Products are invoiced at the rates in effect at the time the order is placed.
Shipping costs are displayed before final order confirmation and vary depending on the delivery method and destination.
Article 4 — Orders
Customers place orders on lou-gaston.com by following the online ordering process. Validating an order implies acceptance of these Terms and Conditions and constitutes a sales contract.
A confirmation email is sent to the customer after the order is placed. Lou & Gaston reserves the right to cancel any order in the event of payment issues, incorrect addresses, or any other account-related problems.
Article 5 — Payment
Payment is made online at the time of ordering. Accepted payment methods are listed on the website. Transactions are secured with SSL encryption.
The order is confirmed once payment is approved by the payment provider. If payment is declined, the order is automatically cancelled.
Article 6 — Personalized Products
Personalized products (embroidery, engraving, etc.) are made according to the information provided by the customer. The customer is responsible for the accuracy of the information provided (spelling of names, color choices, etc.).
Important: personalized products cannot be returned or exchanged, except in cases of manufacturing defects or errors attributable to Lou & Gaston.
Article 7 — Delivery
Orders are shipped to the address provided by the customer at the time of ordering. Delivery times are estimates and vary depending on the destination and chosen delivery method.
Typical delivery times are:
- Metropolitan France: 3 to 5 business days.
- Europe: 5 to 10 business days.
- International: 7 to 15 business days.
Personalized items require an additional production time of 2 to 4 business days before shipping.
Lou & Gaston shall not be held liable for delivery delays attributable to the carrier or force majeure events.
Article 8 — Right of Withdrawal
In accordance with applicable law, the customer has 14 days from the date of receipt to exercise their right of withdrawal, without having to provide a reason.
Exceptions: the right of withdrawal does not apply to personalized products (embroidery, engraving) in accordance with applicable consumer protection laws.
To exercise this right, the customer must notify their decision by email to contact@lou-gaston.com and return the product(s) in their original condition, unused and in their original packaging.
Article 9 — Returns and Refunds
Return shipping costs are the responsibility of the customer, except in cases of defective products or delivery errors.
Refunds are processed within 14 days of receiving the returned product, using the same payment method as the original order.
Returned products must be in perfect condition, unworn, unwashed, and in their original packaging.
Article 10 — Warranties
All products sold on lou-gaston.com benefit from the legal warranty of conformity and the warranty against hidden defects under applicable French consumer law.
In the event of a non-conforming or defective product, the customer may contact customer service at contact@lou-gaston.com to arrange an exchange or refund.
Article 11 — Liability
Lou & Gaston shall not be held liable for failure to perform the contract in cases of force majeure, postal or transport service disruptions or strikes, floods, or fires.
Product photographs and descriptions on the website are as accurate as possible but shall not hold Lou & Gaston liable for slight differences with the delivered product.
Article 12 — Intellectual Property
All elements of the lou-gaston.com website (texts, images, logos, illustrations) are the exclusive property of Lou & Gaston or its partners. Any reproduction, representation, or distribution, in whole or in part, is prohibited without prior written authorization.
Article 13 — Personal Data
The collection and processing of personal data are described in our Privacy Policy.
Article 14 — Applicable Law and Disputes
These Terms and Conditions are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing an amicable agreement, the competent courts shall be those of the jurisdiction of Lou & Gaston's registered office.
In accordance with consumer protection regulations, the customer may seek recourse through a consumer mediator in the event of an unresolved dispute.
